Migración (en la jurisprudencia de la Corte Interamericana de Derechos Humanos)

Resumen

El analisis de la jurisprudencia de la Corte IDH relativa a no nacionales, permite constatar el desarrollo de elementos particulares para el analisis de la violacion de derechos humanos en contextos de migracion. Se observa un lento y paulatino surgimiento de la sensibilidad por parte de los actores del SIDH en torno a las condiciones de vulnerabilidad en las que se encuentran las personas, cuando sus derechos humanos son violados por un Estado del cual no son nacionales. Emerge la incipiente consideracion de la violacion de la libertad de circulacion cuando una persona se ve obligada a dejar el pais de su nacionalidad y solicitar proteccion en otro Estado, luego de haber sufrido violaciones a sus derechos humanos. La Corte IDH debe continuar en el desarrollo y consolidacion del analisis de condiciones de vulnerabilidad como un marco de referencia en casos de victimas no nacionales. Abstract: The analysis of the jurisprudence of the Inter-American Court of Human Rights relating to the situation of the no nationals helps to develop the particular elements for the analysis of the human right’s violations in migration contexts. Migrant’s vulnerability conditions when living in a foreign country have gradually increased the sensitivity regarding the protection of migrant persons on the part of the Inter-American System’s institutions. An incipient concern about the rights violations when a national is compelled to migrate when her state infringes her rights is also gaining importance in the Inter-American System and in the Inter-American Court’s jurisprudence. Nevertheless, the Court should continue to develop and consolidate the analysis of the conditions of vulnerability in cases of human right’s violations of migrant persons.
