This paper aims to investigate the possibility that a regional agreement such as NAFTA/USMCA could mitigate existing inequality problems in the regional human capital market in North America from the theoretical perspective of migration governance. The methodological strategy involved sanalysing economic indicators and reviewing the three countries' legislative framework for recruiting skilled workers. The results show that the governance of skilled migration follows patterns of regional economic inequality. It leads to the conclusion that regional agreements such as NAFTA/USMCA increase the loss of skilled workers without fostering a truly free movement of professionals in the region. However, this situation could change due to the increase in virtual work, as it could make regional talent mobility more flexible, or in the event of a possible termination of the regional agreements, so further research on the topic is necessary.
