espanolEl Real Decreto-ley 7/2018, de 27 de julio, sobre el acceso universal al Sistema Nacional de Salud ha venido a revertir la reforma operada por el Real Decreto-ley 16/2012, de 20 de abril, de medidas urgentes para garantizar la sostenibilidad del Sistema Nacional de Salud y mejorar la calidad y seguridad de sus prestaciones en materia de derecho a la asistencia sanitaria y mas concretamente en lo que tenia que ver con la privacion del derecho a la asistencia sanitaria con cargo a fondos publicos de los extranjeros que se encontraran en una situacion irregular en Espana. Esta reforma viene precedida de diversas sentencias del Tribunal Constitucional sobre la anterior norma y trata de recuperar un principio de universalidad de la prestacion sanitaria en Espana. Para llevar a cabo la modificacion se regula el concepto de titular y el reconocimiento del derecho a la proteccion a la salud y a la atencion sanitaria con especial mencion a la proteccion de la salud y atencion sanitaria a las personas extranjeras que encontrandose en Espana no tengan su residencia legal en el territorio espanol y la aportacion farmaceutica de las mismas. Se reformulan y mantienen los conceptos de asegurado y beneficiario pero unicamente a efectos de lo previsto en la normativa internacional y la aportacion a la prestacion farmaceutica EnglishThe Royal Decree-law 7/2018, of July 27, on universal access to the National Health System has come to reverse the reform operated by Royal Decreelaw 16/2012, of April 20, of urgent measures to guarantee the sustainability of the National Health System and improve the quality and safety of its benefits in terms of the right to healthcare and, more specifically, in relation to the deprivation of the right to health care charged to public funds of foreigners that they were in an irregular situation in Spain. This reform is preceded by various judgments of the Constitutional Court on the previous rule and seeks to recover a principle of universality of health provision in Spain. To carry out the modification regulates the concept of holder and the recognition of the right to health protection and health care with special mention to the protection of health and health care for foreigners who are in Spain do not have their legal residence in the Spanish territory and the pharmaceutical contribution of the same. The concepts of insured and beneficiary are reformulated and maintained but only for the purposes of the provisions of the international regulations and the contribution to the pharmaceutical benefit
