Aplicabilidad de la opinión consultiva 18 en el Ecuador y políticas públicas sobre migración

Resumen

This work shows the need to study the reality and the legal basis that Ecuadorian migrants have abroad. During research time various changes and findings appeared, since the original idea was to seek the space where assistance to migrants had been expressed; the space that has been sought and many times achieved and that also went frequently wrong by different sectors and governments. Besides, the analysis of various existing instruments, which were in debate and that now are a reality, have also been object of this work. The reality of the country and foreign attraction have an influence on the migration of people and entire families, it is the starting point for drafting the social and legal reality of migrant people, as well as the advances toward the mechanisms of protection in the country of destiny. The development and interest for this topic is given to the emergent reality in the country, which favors the State to begin the assistance to Ecuadorian migrants not only abroad, in the country of destiny, but in their own country of origin. As a consequence, studies of international concepts that define types of migrations and migrants and the possible mechanisms of protection and implementation of public policies, plans and programs exist.
