Resumen

Spanish Abstract: Desde tiempos inmemoriales el ser humano se ha desplazado de un lugar a otro, ya sea por razones tan inocuas como un cambio de escenario como por razones de indole mas problematica como las guerras o las persecuciones de las que son objeto por parte de individuos que gozan de poder, sea este belico o politico. En la actualidad los movimientos migratorios pueden encontrar su origen en la devastacion que trae consigo el cambio climatico y ello conlleva aceptar una realidad completamente diferente a la ya conocida, que pasara con estas personas que deben abandonar todo porque su hogar se ha vuelto hostil, que pasa cuando ya no pueden desplazarse mas dentro de las fronteras de los Estados de los que son nacionales, quien los protege. Este ultimo es el punto central de este trabajo, tratar de encontrar un marco juridico que resulte adecuado para cumplir con la tarea de proteger a estos individuos.English Abstract: Since the beginning of times, humans have moved from place to place, for reasons as innocent as a desire for a change of scenery or for more problematic reasons such as wars or the persecution they are subjected to by the persons in power, be that military or politic. At present times the migration movements can find their origin in the devastating effects of the climate change and that entails the acceptance of a new reality completely different from what we know, what will happen to the people that are forced to leave everything behind because their home has turn hostile? What will happen when they can’t move further inside the States they are nationals of? Who will protect them? That last point is the focus of this paper, find an adequate legal frame that will have the mission to protect this people.
