espanolEl panorama normativo relativo a los derechos del paciente es realmente complejo. En los ultimos anos han ido prosperando multitud de normas de ambito internacional, estatal y autonomico que regulan la materia. A la luz de la Convencion de las Naciones Unidas de 13 de diciembre de 2006 sobre los Derechos de las Personas con Discapacidad hay que descartar, de inicio, la posibilidad de que el consentimiento a un tratamiento o actuacion medica pueda otorgarse por representacion o substitucion y revisar los supuestos contemplados por las leyes que coexisten en el territorio espanol, y tambien por la Ley basica estatal 41/2002, de 14 de noviembre, reguladora de la autonomia del paciente y de derechos y obligaciones de informacion y documentacion clinica. La garantia del ejercicio de este derecho que corresponde ofrecer a un Estado de Derecho pasa por facilitar a todas las personas las medidas de asistencia y apoyo necesarias para posibilitar su adecuado ejercicio. In recent years they have been thriving multitude of rules of international , national and regional level governing the matter . In light of the United Nations Convention of 13 December 2006 on the Rights of Persons with Disabilities be ruled out , start, the ability to consent to treatment or medical intervention may be granted by representation or substitution and review the cases covered by the laws that exist in the Spanish territory , and also by the state Basic Law 41/2002 of 14 November, regulating patient autonomy and rights and obligations of clinical information and documentation .
