Resumen
This article presents a critical analysis of the institutional design for the recognition of cross-border indigenous nations in Colombia, which shows the absence of legislative development to ensure the practice of ancestral territorial mobility, which causes an assimilation of the mobilizations indigenous as international migration. To develop the purpose of this study, we look to the situation of the wayuu indigenous people from Venezuela who have been identified, in Colombian territory, as Venezuelan citizens and not as transboundary natives.
